FAQs

The following has been prepared for the general information of potential customers and should not be construed as legal, tax or financial advice and should not be acted upon without professional counsel. Potential customers are advised with this notice to seek council and advice from a tax accountant or attorney regarding their specific facts and circumstances. 1. Do I have to have delivery of the vehicle before December 31st, 2009?    The law does not mention the words "deliver", "license", “register” or "tag".  However the law does require that a purchaser "acquire" the vehicle on or before December 31st, 2009. There has been a lot of confusion regarding what "acquire" means. Some people feared that it meant "delivered".  The IRS answered this question on November 13th, 2009.  Click HERE to see the IRS answer (http://www.irs.gov/newsroom/article/0,,id=215521,00.html).   When you complete your purchase, the manufacturer will release the VIN# and issue the Manufacturer's Statement of Origin (MSO) for your vehicle.  The MSO is recognized as a valid form of legal title and is the original ownership document for every new car.  Please check with your tax and legal advisor for further guidance.
 2. Can I claim the credit on more than one vehicle? Please refer to the IRS website where they have answered this question by clicking HERE.( http://www.irs.gov/newsroom/article/0,,id=215521,00.html)
3. How much is the Federal Tax Credit? Zone Electric Car, LLC has received certification for these vehicle models from the US Department of the Treasury for a Federal Tax Credit of $6,496.53. To see more details on the qualifications of the Zone Electric Car vehicles, please refer to the first 2 links on the Tax Credit page.
4. Do all electric vehicles get a tax credit? No. Manufacturers must submit their vehicles for certification to the US Department of the Treasury for certification in order for Taxpayers to receive a tax credit. If the vehicle has not been certified, you will not receive a tax credit.
5. Do all electric vehicles qualify for the same tax credit? No, the tax credit is based on the electric capacity of the specific model vehicle. By investing in the latest technology and the best available high capacity batteries, the Zone Electric Car models receive a much higher credit.
6. When can I expect to receive the vehicle I purchase?  As of the time of this posting, delivery times are estimated to be 6 to 12 weeks.  While the IRS did not require “delivery” before the end of the year, the delivery schedule is based on the date of purchase and customers are encouraged to place their orders as soon as they can.
7. How do I receive the Federal Tax Credit? Taxpayers must acquire a qualified vehicle on or before December 31, 2009. To “acquire” a vehicle you must have a legal form of title ownership to the vehicle, recognized under the laws of your State. 
8. I usually get a tax refund, can I still qualify for the credit?  Many people have taxes taken out of their checks each pay period.  At the end of the year they might get a refund for a portion of what was taken out of their check, but they still paid Federal Income Tax.  So if you had $10,000 withheld from your paychecks during the year and got a $2,000 refund at the end of the year –you still paid $8,000 in Federal Income Taxes ($10,000-$2,000).  If you acquired a qualified Zone Electric Car, you would receive an additional refund of $6,496.53 (in addition to your regular $2,000 refund)!  Seek advice from your tax professional for help in determining your tax liability. 
9. If the tax credit for the vehicle exceeds my Federal tax liability, will I get the difference in the form of a refund? No. However, in the case of vehicles purchased for a C-Corp business use, credits in excess of Federal tax liability can be carried back 1 year and carried forward 20 years.
10. Can the tax credit be used against the alternative minimum tax (“AMT”)? Yes! There is no income limit! 
11. What is the warranty on the vehicle and who will service the vehicle? Both the Western Golf Car and Zone Electric Car line of vehicles have a one year limited warranty.  The separately manufactured components of the vehicle are covered by their own warranties, such as the batteries, controller, and charger.  The vehicles can be serviced by any service shop familiar with these types of electric cars.  In the event there is a warranty issue with any items covered by the vehicle manufacturer's warranty, the manufacturer will contract with an independent repair facility in your area. 12. When I call your toll free number, I am sometimes connected to a call center.  As you can imagine, we are receiving a very high call volume and can not personally take every call.  Please take the time to explore our website where you will find the answers to most of your questions.  You can then place an order online, which is the best way to place your order.  If you have questions that are not answered on this site, please send us an email on the "Contact" page.  We will respond to your questions as quickly as possible.
13. I am having trouble placing my order online.  Where can I get help? Call our toll free number (877-900-ECARS) and press "1".  A common problem occurs when someone attempts to purchase multiple vehicles at the same time.  For fraud protection purposes, you can only purchase one vehicle per day (per credit card and email address). If you wish to purchase multiple vehicles at the same time, please send an email to quantity@FreeElectricCar.com  for assistance.  
14. Tell me about the controller, charger and the batteries? The controller is made by Curtis (http://curtisinst.com/ ), the charger is made by Delta Q (www.delta-q.com) and the batteries are made by US Battery.  Each carries its own 1 year manufacturer's warranty.  The Delta Q charger is an onboard charger and can be plugged into any 110 outlet. Batteries, if properly taken care of, can last five years or more and replacement batteries are estimated to cost between $600 and $1,500.
15. Can I sell or donate the vehicles to a non-profit organization or a government agency and claim the tax credits? Yes. Check with your accountant for details.

16. What is a Low Speed Vehicle (LSV)? LSVs are street legal vehicles, subject to state restrictions, regulated by the National Highway Traffic Safety Administration (NHTSA) (49 CFR 571.500). All vehicles sold by Drive Electric, LLC are NHTSA compliant and comes with a 17 digit VIN #.
17. I have heard that there is a cap on how many vehicles a manufacturer can sell and that the credit will then be reduced. How does this apply to purchasing a vehicle from Drive Electric? This will not apply to any vehicles sold by Drive Electric in 2009. The 250,000 sales figure has not been reached yet and once it is reached the phase out only applies to purchases starting in the second quarter following when the limit is reached.  So if the limit is reached before the end of the year, the phase out period would not begin until April 1st, 2010 -which is 90 days after the deadline for purchasing this class of vehicle.
18. Do I pay sales tax and do I have to license and register the vehicle? Oklahoma residents are required to pay the excise tax when they purchase their tags.  For sales outside the State of Oklahoma, we do not collect sales tax.  It is your responsibility to determine if you owe sales tax in your State of residence.  To receive the tax credit, there is no specific requirement in the subject tax law to license, register and insure the vehicle.  However it is the purchaser's responsibility to determine the laws and regulations in their place of residence and to consult with their legal and tax advisor regarding their specific circumstance.
